Welcome to Oxxy website operated by Oxxy Network LLP, referred to as Oxxy herein.  The term site and/or website and/or App and/or Call Center/s in this entire document would collectively mean Oxxy Website, Oxxy App and Oxxy Call Centers. Any term in the website   used for doctors and/or places where medical tests and/or treatments and/or surgeries and /or any medical procedures/consultations are done will be termed as center/s and/or hospital/s and/or diagnostic center/s and/or pathlab/s and/or eye/dental clinic/s and/or medical/health center/s.
Oxxy provides its services at   to you subject to the following conditions. Before you may use the Site, you must read and accept all of the terms and conditions in, and linked to, this Terms of Use, Disclaimer and the linked Privacy Policy. We strongly recommend that, as you read this ToU, you also access and read the linked information, since it is incorporated into and hereby made part of this ToU. This ToU is effective upon acceptance. Use of any functionality of the Site constitutes acceptance of this ToU. Every test shall be booked through Oxxy at a center of your choice at least 5 working days in advance. The center, hospital, diagnostic center,  would meanIf the center of your choice is not available on Oxxy Network, Oxxy will help get that center on its network else help you with another center on its network. Oxxy assumes no responsibility of any kind and by selecting the center you indemnify Oxxy for any mishapening before, during & after the tests. Test/s would mean consultations, appointments, tests, procedures, surgeries, medicines or anything even if it is not mentioned in this ToU/T&C.

1. Description of Services

In the Site, Oxxy provides users with access to information primarily about Healthcare Services including but not restricted to Diagnostic Services and medical services (the "Service"). You are responsible for obtaining access to the Site, and that access may involve third-party fees (such as Internet service provider or airtime charges). In addition, you must provide and are responsible for all equipment necessary to access the Site. By making use of this site, and furnishing your personal / contact details, you hereby agree that you are interested in availing and purchasing the services that you have selected. You hereby agree that  Oxxy or/and its associates may contact you either electronically or non electronically, to understand your interest in the selected products and services and to fulfill your demand. You also agree that Oxxy reserves the right to make your details available to partners and you may be contacted by the partners for information and for sales through electronically or non electronically. You agree to receive promotional materials and/or special offers from Oxxy.

The Service is available to anyone who registers with Oxxy. Users may not have more than one active account. Additionally, users are prohibited from selling, trading, or otherwise transferring their accounts to another party.

Oxxy Standard Members are restricted to avail info of healthcenters.

Either of the Oxxy Plans can be used at a time.
Members cannot club oxxy Healthplan benefits with EMI no interest features.

4. Your Account

In consideration of your use of the Site, you represent that you are of eligible to form a binding contract and are not a person barred from receiving services under the laws of India or other applicable jurisdiction and will only use the Site to make legitimate purchases for you or for another person for whom you are legally authorized to act (and will inform such other persons about the ToU and/or Privacy Policy) that apply to the purchase you have made on their behalf (including all rules and restrictions applicable thereto). You also agree to provide true, accurate, current and complete information about yourself as prompted by the Site. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Oxxy has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Oxxy has the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). The code generated by this Site for your use is valid for up to seven (7) days and can only be used once. All tests/ procedures etc. must be booked at least 5 (five) days in advance of the date on which the test/ procedure is to be conducted, Oxxy does not provide healthcare services and only offers information and access to healthcare services by booking appointments and/or giving discounted rates and is in no way responsible for any outcomes as a result of availing the services. Oxxy does not guarantee any time for providing of services by your chosen healthcare service provider. The services provided by the Healthcare service Provider that require such Healthcare service Provider to have an up-to-date regulatory authorization, license, or certification are not verified, validated, or cross checked by Oxxy. Oxxy is not responsible for any regulatory breach or malpractice by such Healthcare service provider.

6. Refund Policy

HEALTH PLANS CAN BE REFUNDED ONLY UP TO 48 HOURS OF PURCHASE. IF REFUND IS ACCEPTED BY OXXY, PROCESSING CHARGES WILL NOT BE REFUNDED (50% ARE PROCESSING CHARGES, NON REFUNDABLE; AND 50% ARE PLAN CHARGES).
NO REFUND WILL BE ENTERTAINED AFTER THE STIPULATED TIME LIMIT UNDER ANY CIRCUMSTANCES.

CUSTOMERS ARE ADVISED TO READ THE SERVICES MENTIONED ON THE WEBSITE AND OXXY IS NOT LIABLE TO PROVIDE ANY ADDED SERVICES OTHER THAN MENTIONED ON THE WEBSITE, ALL COSTS FOR MEDICAL TREATMENT SHALL BE BORNE BY THE CUSTOMER ONLY.

REFUND SHALL BE MADE IF THE COMPLAINT IS RAISED WITHIN 48 HOURS OF PURCHASE & ONLY IF OXXY IS UNABLE TO SERVICE THE CUSTOMER. OXXY WILL NOT BE HELD RESPONSIBLE FOR THE DELAYS ON THE PART OF THE HEALTH CENTRES DUE TO ANY REASON. NO MONEY WILL BE REFUNDED BY OXXY IN SUCH A SCENARIO.

There will be no refund if there is a new policy or change in existing policy by government or any other agency effecting Oxxy business model in future.

OXXY HEALTH PLANS PURCHASED BY CORPORATES ARE NON-REFUNDABLE .

7. Submitted Content

Oxxy does not claim ownership of any materials you make available through the Site. At Oxxy's sole discretion, such materials may be included in the Service in whole or in part or in a modified form. With respect to such materials you submit or make available for inclusion on the Site, you grant Oxxy a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such materials (as well as use the name that you submit in connection with such submitted content). The limitations of liability provided in these terms inure to the benefit of Oxxy, Its Affiliates, and/or their respective suppliers.

13. Indemnity

You agree to indemnify and hold Oxxy (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including reasonable attorneys' fees, or arising out of or related to your breach of this ToU, your violation of any law or the rights of a third party, or your use of the Site.

14. Electronic Communication

When you use the Site or send emails to Oxxy, you are communicating with Oxxy electronically. You consent to receive communications from Oxxy electronically. Oxxy may communicate with you by email or by posting notices on the Site or by phone or usually available means of communication. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

15. Site-Provided Email and Postings

The Site may provide users with the ability to send email messages to other users and non-users and to post messages on the Site. Oxxy is under no obligation to review any messages, information or content ("Postings") posted on the Site by users and assumes no responsibility or liability relating to any such Postings. Notwithstanding the above, Oxxy may from time to time monitor the Postings on the Site and may decline to accept and/or remove any email or Postings. You understand and agree not to use any functionality provided by the Site to post content or initiate communications that contain: (i) Any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law; (ii) Advertisements or solicitations of any kind; (iii) Impersonate others or provide any kind of false information; (iv) Personal information such as messages which state phone numbers, account numbers, addresses, or employer references.; (v) Messages by non-spokesperson employees of Oxxy purporting to speak on behalf of Oxxy or containing confidential information or expressing opinions concerning Jetsetter; (vi) Messages that offer unauthorized downloads of any copyrighted or private information; (vii) Multiple messages placed within individual folders by the same user restating the same point; (viii) Chain letters of any kind; or (ix) Identical (or substantially similar) messages to multiple recipients advertising any product or service, expressing a political or other similar message, or any other type of unsolicited commercial message. This prohibition includes but is not limited to a) Using Oxxy to send messages to people who don't know you or who are unlikely to recognize you as a known contact; b) Using Oxxy to connect to people who don't know you and then sending unsolicited promotional messages to those direct connections without their permission; and c) Sending messages to distribution lists, newsgroup aliases, or group aliases.

16. Links

The Site or third parties may provide links to other World Wide Web sites or resources. Because Oxxy has no control over such sites and resources, you acknowledge and agree that Oxxy is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Oxxy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

17. Access To Password Protected/Secure Areas

Access to and use of password protected and/or secure areas of the Site is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Site may be subject to prosecution.

18. Modification and Notification of Changes

Oxxy reserves the right to make changes to the Site, related policies and agreements, this ToU and the Refund Policy, Disclaimer, Privacy Policy at any time. If Oxxy makes a material modification to this ToU, it may notify you by displaying a prominent announcement above the text of this ToU or the Privacy Policy, as appropriate, for thirty (30) days, being deemed sufficient notification, of such changes. After notice of a modification to the ToU or the Privacy Policy has been posted for 30 days, the notice will be removed. If you have not used the Site for more than 30 days, you should check the ToU and/or Privacy Policy prior to any further use of the Site. Should you wish to terminate your account due to a modification to the TOS or the Privacy Policy, you may do so by sending an email with the subject line "Termination" to the following email address: support@oxxy.in. If you choose to continue using the Site, you agree that by doing so you will be deemed to accept the new ToU, Privacy Policy, Refund Policy and Disclaimer.

19. Trademarks

The trademarks, logos and service marks ("Marks") displayed on the Site are the property of Oxxy and other parties. Users are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or sites on the World Wide Web without the written permission of Oxxy. All information and content including any software programs available on or through the Site ("Content") is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.

20. Survival of Terms After Agreement Ends

Notwithstanding any other provisions of this ToU, or any general legal principles to the contrary, any provision of this ToU that imposes or contemplates continuing obligations on a party will survive the expiration or termination of this ToU.

21. General

If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Headings are for reference purposes only and do not limit the scope or extent of such section. This ToU and the relationship between you and Oxxy will be governed by the laws of the India without regard to its conflict of law provisions. You and Oxxy agree to submit to the personal jurisdiction of the courts located in New Delhi jurisdiction with respect to any legal proceedings that may arise in connection with this ToU. The failure of Oxxy to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Oxxy does not guarantee it will take action against all breaches of this ToU. Except as otherwise expressly provided in this ToU, there shall be no third-party beneficiaries to this ToU. This ToU constitutes the entire agreement between you and Oxxy and governs your use of the Site, superseding any prior agreements between you and Oxxy with respect to the Site.

  1. Employees, partners and associated staff of Oxxy are not accountable for any loss, harm or damage occurring due to usage of information from the portal. Customers are advised to use their own discretion in such matters. Oxxy is not legally responsible for the same in any matter what so ever. 
  2. Oxxy Health Plan assists the customer with rates and get bookings only. It may also help in discounts wherever applicable. Oxxy health membership in no way is an Insurance Policy. The customer may add it on to his Insurance Policy if he feels its appropriate. Please check with your Insurance Provider for the same.
  3. The facts & figures stated anywhere on the site are approximate and a personal view point of Oxxy Team and holds no responsibility. User is adviced to do their own research before using Oxxy services.
  4. The rates may vary/change any time and Oxxy holds no responsibility.
  5. Please do an in-depth survey of the market and purchase Oxxy Health Plan at your own risk. If you agree to purchase Oxxy Health Plan and become its member, it is understood that you have done it with your own free will & full consent and you indemnify Oxxy fully.
  6. Oxxy will try its best to pass on the discounts to the Oxxy Health Plan customers wherever possible but in no way is liable for the same. This depends on Oxxy's understanding with the various Medical Centers and may differ at different times and on case to case basis.
  7. Health care centers displayed may not be tied up due to contstant change in understanding with those health centers. Members must write an email to know exact status of any perticular health care center at that time and discounts offered. Location of health centers may not be accurate in the map. Please call up the health center directly for exact location. Oxxy will not liable.
  8. Oxxy will try its best to offer you the Medical Center of your choice else it will help you avail the services at an alternative empaneled medical center.
  9. Oxxy does not hold any responsibility for the quality of Medical Center. All medical centers are working independently of Oxxy and by no means Oxxy looks after their management or their capabilities. The patient will be utilizing the services at his/her own risk.
  10. Oxxy holds no responsibility for any commitments made by any agents. The customer is strictly adviced to read Oxxy Policies before purchasing Oxxy Health Plan.
  11. List of most Medical Centers is available on ‘Oxxy.in’. The customer agrees to the fact that list of centers is a dynamic process and addition and deletion of the centers keep happening.
  12. Bookings and/or Discounts are available in most Medical Centers empaneled in Oxxy network only.
  13. Booking appointment thru Oxxy website is a way to authorize and request Oxxy to help in fixing the time slot as per the convenience of the customer, however final discretion is on the availability of medical centers and its practitioners and Oxxy hold no responsibility whatsoever.
  14. The customer must Generate a booking code in advance BEFORE going to/contacting the Medical Center. Unless the booking code received on the cellular phone as sms is shown to the Health Center, the Health Center may not abide by their understanding with Oxxy.
  15. Since it's unprofessional, Oxxy highly discourages no show after booking. If there is a no show after booking the appointment, the user will be blocked to book again for next 4 months.
  16. Medicines will be delivered as soon as posible after receiving the complete order and prescription during working hours subject to availability of medicines at the partnered network & subject to availability of network partners in that location.
  17. Please Only Communicate on 9999-000-102 for any information / clarification regarding your services. Oxxy do not hold any responsibility of any communication done through any other number.

Terms of Use for Health Camps

  1. Oxxy, with the help of the associated partners (including but not limited to medical centres) in its endeavor bridge the gap between the user and healthcare service providers, provides a platform to such healthcare service providers via a health camp to showcase its prospective services to their end users. However, All Camps are done through Network Partners and Oxxy cannot guarantee the quality of services or accuracy of results.
  2. Camp Locations/ Medical Centers may change at last minute as Oxxy is dependent on third party for execution.
  3. The Healthcare service provider may provide its services at nominal rates (including a free check-up). However, this is solely at the discretion of such healthcare service provider. Please find out the details from the respective center before getting the test done.
  4. It’s a platform with intention of a noble cause and Oxxy bears no responsibility for any  loss and/or damage caused to the user on account of any misconduct and malpractice on part of the healthcare service provider. Patient is advised to use the camp services solely at his/her own risk.
  5. The data collected by Oxxy and its Partners  may be used for health awareness in future.

Policy for International Patients

  1. Oxxy guarantees saving of USD 1000 to the patients when they buy Save $2000 plan and book all their tests & treatments in India through Oxxy. The plan for International Patients is for One time use only and the savings can not be availed more than once.
  2. The saving of USD 1000 collectively will be on the listed test/treatment price at the Hospitals/Health Centers. The savings will be passed on to the patient at the time of settling the bill, provided the cost of the entire bill is over USD 5000 and the patient has generated the codes from Oxxy before going to the Hospital.
  3. Oxxy is not a healthcare institute and does not own any Medical or Health facility. Oxxy is only a network of Healthcare Centers/Hospitals and is working towards making Healthcare affordable.
  4. It is clearly understood that the patient has purchased the plan with his own free will and no one has coerced them into buying. They will indemnify Oxxy of any wrong doings of any kind.
  5. In case of wrong treatment/injury/anything else or even death, Oxxy is not liable as Oxxy is not doing any treatment themselves.
  6. Oxxy may suggest the Hospitals in its network but it is up to the patient to decide where they want to get treated. Oxxy holds no liability for the treatment and the kind of Hospital or quality of Hospital.
  7. The plan once purchased can not be refunded unless Oxxy fails to provide savings of USD 1000 even after all the above mentioned points are fulfilled.
  8. In the worst case scenario, maximum liability of Oxxy will be to refund the cost of purchasing the plan to the customer.
  9. Customer is liable to check if there are any governing laws in their country for availing Oxxy services in India. Also they need to check that Indian laws do not prohibit their nationality to avail Oxxy savings.
  10. The plan purchased are non-transferable.
  11. Plan cost to be refunded if $1000 not saved.

TEST COLLECTION FROM HOME FOR NON - PLAN HOLDERS

  1. Oxxy is providing this service by finding the available Govt approved pathlabs/ health centers which can perform the medical tests and do collection of samples from home.
  2. The service is available for a small convenience charge.
  3. For Oxxy's Home Test Collection, The customer is charged for Oxxy's effort to look for Govt approved centers which can collect the samples.
  4. The tests are openly available in the health centers and the customers may avail the services directly also without involving Oxxy.
  5. The test charges including the pick up charges have to be paid directly to the person who will collect samples, at the time of sample collection.
  6. The convenience charges have to be paid in advance for Oxxy to find the centers. In the event Oxxy is unable to find any center on that particular date or time, it will give an alternate center, date and time. There will be no refund of the charges.
  7. If the customer books a test and then cancels, the convenience charges will not be refunded.
  8. The convenience fee is non-refundable if there is a dispute of charges with the person who will collect samples.
  9. Oxxy holds no responsibility for any delay in sample collection or obtaining the result as they are being directly done by the pathlab/health centers.
  10. The customers must verify the accredition of hte pathlab/health center before giving the sample on their own.
  11. Oxxy holds no responsibility for the quality of pathlab/health centers as they are assumed to be Govt approved centers. However if there is a complaint against a center or their quality, Oxxy may block the services of that center for future use.
  12. If the agent does not reach at the address given by the customer on the date customer requested, customer will get full refund of the convenience charges paid. If the agent reaches late but on the same day, then there is no refund. Agents may get late as they have to collect a lot of samples.
    Customers will have to still pay full charges for the tests and home collection.

Policy for Bandhan Bank Customers

Policy for Unlimited Healthcare Expenditure

Oxxy helps to get discounts on a customer's bill, and that bill could be for an unlimited amount, as per Oxxy's understanding with the healthcare service provider. The customer has to pay the balance amount after the discount.

Policy & Limit of Discount percentages:

  1. 10%* : up to 10% discount
  2. 20%* : up to 20% discount. Minimum 10% discount
  3. 25%* : up to 25% discount. Minimum 10% discount
  4. 30%* : up to 30% discount. Minimum 10% discount
  5. 40%* : up to 40% discount. Minimum 10% discount

Policy for Cancer Plan Refunds

  1. The Tests/Treatments/Surgeries should be booked at least 3 days in advance at Oxxy empanelled centers only.
  2. The patients must take Oxxy discount code by calling 9999000102.
  3. Patient's bill value at these empanelled centers should be at least 10 times the plan cost.
  4. If after this the patient is not able to recover their plan cost, pro rata refund with max refund of 50% shall be refunded provided all Oxxy norms are met.
  5. For refunds, proof of Oxxy code & empanelled center bill is required.
  6. If the Cancer plan is not used or used for bill value less than 10 times of the plan cost, no refund shall be entertained.

DATA STORAGE POLICY

  1. Data is stored for the purpose of serving the customer in future and helping with their health.
  2. Personal Data of any customer may be deleted by giving a written request on info@oxxy.in

1. Digital Product Delivery:

- Upon successful purchase of a health plan, customers will receive digital documentation and details via email.

- Customers availing health plans can access our network of affiliated helath centre for medical treatment.
- Discounts on medical bills are applicable within our network of helath centre upon presentation of the provided health plan details.

3. Processing Time:

- Digital health plan documents will be delivered to the customer's registered email address instantly after purchase.

- Our dedicated customer support team is available to assist with any queries related to e-shipping, digital delivery, or health plan details.

  1. Every test shall be booked through Oxxy at a center of your choice at least 5 working days in advance. If the center of your choice is not available on Oxxy Network, Oxxy will help get that center on its network else help you with another center on its network. Tests/procedures would be including delivery & neo natal tests for the new born. Failure to skip any tests in the list after your registration, or not do the same booked through Oxxy will automatically terminate this offer. Oxxy assumes no responsibility of any kind and by selecting this offer you indemnify Oxxy for any mishappening before, during & after the tests. Test cost has to be borne by you.
  2. The plan purchaser must call up or write to Oxxy for activation of complimentary life insurance coverage based on which Oxxy partners will take a call and if found eligible will activate the service.
    Life insurance coverage can not be activated till there is a formal request and other documents such as age proof and nominee details are submitted.
    However all Oxxy services will continue to be in operation.
  3. According to Oxxy understanding and implementation of Indian Laws, the plans are covered under section 80D, However Oxxy still recommends the buyer to consult their legal advisor/ CA at the time of buying the membership plan. Oxxy will not hold any responsibility for the same.
